Services Offered
XPMKT, LLC provides digital marketing, branding, website development, hosting, advertising management, and subscription-based services.
All services are customized and digital. No physical products are sold.
Payments & Billing
All services must be paid in advance, unless otherwise agreed in writing.
Payments are processed securely via Stripe, Wise, or other approved payment processors.
By subscribing, you authorize recurring billing according to your selected plan.
Failure to make payment may result in suspension or termination of services.
All prices exclude applicable taxes and third-party platform fees (Google, Meta, Shopify, Mailchimp, etc.).
No Refund Policy
Due to the nature of digital and customized services:
All sales are final
No refunds are issued once work has started
No refunds for unused service time, early termination, or change of mind
Details regarding cancellations and penalties are governed by the signed service agreement, when applicable.
Subscriptions & Cancellations
Subscription services renew automatically unless canceled according to the service agreement
Minimum commitment (“Grace Period”) may apply
Cancellations requested before completion of the minimum term may be subject to penalties
Services remain active until the end of the paid billing cycle
Client Responsibilities
The client agrees to:
Provide accurate information and materials required for service delivery
Approve content and deliverables in a timely manner
Ensure compliance with platform policies (Google, Meta, Shopify, etc.)
Maintain active third-party accounts required for services
Delays caused by the client do not entitle refunds or credits.
Intellectual Property
All materials remain the property of XPMKT, LLC until full payment is received
Upon full payment, ownership of final approved deliverables transfers to the client
Drafts, unused concepts, templates, code frameworks, and internal systems remain the exclusive property of XPMKT, LLC
Clients may not resell, redistribute, or reuse materials outside the agreed scope
Revisions
Each service includes a defined revision policy.
Branding and logo services include unlimited revisions until final approval
Additional revisions beyond scope may be billed separately
Third-Party Platforms
XPMKT, LLC is not responsible for:
Policy changes, suspensions, bans, or performance issues on third-party platforms
Advertising results, reach, conversions, or ROI
Fees charged directly by third-party providers
Limitation of Liability
XPMKT, LLC shall not be liable for indirect, incidental, or consequential damages, including loss of profits or data.
Total liability shall not exceed the amount paid by the client within the last three (3) months preceding the claim.
Termination
We reserve the right to suspend or terminate services if:
These Terms are violated
Payments are overdue
The client engages in unlawful or abusive behavior
All outstanding balances remain due upon termination.
Governing Law
These Terms shall be governed by and interpreted according to the laws of the State of Utah, United States.
Any disputes shall be resolved in courts located in Washington County, Utah.
Changes to Terms
We reserve the right to update or modify these Terms at any time.
Continued use of the website or services constitutes acceptance of any changes.
